Real world, if the cop thought he was hammered, he can nail him as soon as he starts the car, as he's in physical control at that point, doesn't have to wait for him to drive.

OK. I'll bite! Real world..wouldn't the police HAVE to wait till he drove out of private property onto the highway or the public land beside it? C'mon Jim! Speak words of wisdom.

Morgan's right. As long as the driver is in a place to which the public has access, he's open to a zip code change. The statute was amended years ago when some bright legislator figured out that a drunk driver can kill someone just as easily in a parking lot or on a beach as he can on a highway.

he can get busted for public intox while walking to his car. but if he sits in the car and the keys are within reach, then he can be busted for dui. i know just cause i almost got a dui, but i had thrown my keys in the back seat. still got a public intox though.... >:(
